Domestic Violence

New Jersey Domestic Violence Defense Lawyer

If you are faced with a charge of domestic violence, or with violating the terms of either a temporary or final domestic violence restraining order, contact the North Arlington office of Howard L. Egenberg, Attorney at Law. Our experience defending against domestic violence charges can protect you from the harsh consequences of a criminal conviction, and can help you avoid many of the unpleasant, inconvenient, and expensive features of a civil domestic violence complaint.

New Jersey's domestic violence laws cover a broad range of abusive conduct between spouses, unmarried parents of a child, former spouses or members of the same household, or persons in a dating relationship. Assault, battery, unwanted sexual advances, threats, repeated stalking behavior, forced entry into a home, or even repeated verbal abuse or humiliation can support both civil and criminal domestic violence complaints.

A person complaining of domestic violence can file civil and criminal domestic violence complaints against an alleged perpetrator, and receive a temporary domestic violence restraining order from a New Jersey Municipal Court judge or Domestic Violence Hearing Officer. A sheriff's deputy or other law enforcement officer will serve a copy of the temporary restraining order on the alleged abuser, who only then will have the right to challenge the finding of domestic violence and vacate the restraining order at a hearing, usually about ten days after the first order.

Most of our criminal domestic violence clients were arrested on restraining order violation charges. Any contact of any kind with the alleged victim in violation of the terms of a temporary or final restraining order can result in your arrest and conviction. Where physical violence, sexual violence, or serious threats are involved, you can be sentenced under the No Early Release Act, which means that you will not be eligible for parole before you served at least 85 percent of your sentence.

Other consequences of a domestic violence restraining order are also extremely serious: you might be barred from your own home, lose the right to see your children without supervision, give up your car to your spouse or domestic partner, lose the right to possess weapons lawfully, and find yourself paying child support or part of the rent for a house you can't even go near.

New Jersey criminal defense attorney Howard L. Egenberg has long experience with advising and representing persons accused of domestic violence, and can protect you from the wide-ranging consequences of a domestic violence conviction or restraining order violation. Contact his office in North Arlington without delay for honest, practical, and resourceful advice if you have just been served with a domestic violence restraining order.
